Lawsuit Filed Against Atmos Energy

A lawsuit has been opened against Atmos Energy on behalf of a resident who allegedly suffered severe burns, smoke inhalation, and other serious injuries while escaping the fire. The complaint alleges that Atmos failed to properly monitor conditions at and around the complex and failed to warn residents about the potential danger of a natural gas leak.

Atmos Energy has denied being directly involved in the construction work that reportedly damaged the pipeline and said it is cooperating with authorities as the investigation continues.

What Happened at The Clyde Apartments?

The explosion occurred at The Clyde Apartments in the 400 block of East 9th Street in Dallas. Fire officials said crews arrived quickly after a reported gas leak, but the blast happened before firefighters could complete evacuation procedures. Dallas Fire-Rescue Chief Justin Ball told local news that firefighters were preparing to enter and evacuate residents when the building exploded.

The explosion and fire destroyed the two-story apartment building. Officials said the complex had 23 units, with 19 occupied by families. Search teams later used drones, cadaver dogs, and specialized rescue crews to search the wreckage. Authorities said they did not expect to find additional victims after residents were accounted for.

Local reports state that three people were killed and at least five others were injured. The fire was described as a five-alarm fire, requiring a large emergency response. Nearby residents reported hearing a loud boom, feeling buildings shake, and seeing smoke and flames after the blast.

Initial Reports Point to Soil Testing and a Ruptured Gas Line

According to NBC DFW, an attorney for the apartment building’s owner said an engineering firm was performing soil testing when a gas line was ruptured. The attorney said a subcontractor was boring in the area when the gas line was hit.

Atmos Energy stated that Dallas Fire-Rescue reported to the company that a construction company unrelated to Atmos had damaged a natural gas pipeline near 409 E. 9th Street. Atmos also said natural gas service in the area remained off while technicians supported first responders and investigators.

Why Gas Leaks Are So Dangerous

If they lead to an explosion, natural gas leaks can become catastrophic. While leaks are often easy to spot due to their “rotten egg” smell as a result of mercaptan, the actual risk of explosion can be difficult to ascertain. During a leak, gas can accumulate in an enclosed or semi-enclosed area and find an ignition source. If that happens, a small spark from an appliance, tool, or electrical wire can be enough to ignite the accumulated gas.

As evidenced by the May 28 incident, these explosions can be truly catastrophic. Survivors of the initial blast often face severe burns, internal damage from the explosion, cuts or head injuries form debris, and sometimes lung damage from exposure to the toxic gas.

Who is Responsible for the Clyde Apartments Apartment Gas Explosion?

True liability for the explosion will be determined in court. However, potentially responsible parties for the explosion may include:

  • The property owners or managers, if they ignored gas odors, failed to maintain safe premises, delayed evacuation, or failed to respond to tenant complaints.
  • Contractors or subcontractors, if they damaged a gas line, failed to call 811, ignored locate markings, used unsafe boring or excavation methods, or failed to stop work after signs of danger.
  • Utility companies, if they failed to inspect, maintain, monitor, repair, mark, or warn about dangerous gas infrastructure.
  • Manufacturers or maintenance companies, if defective equipment, valves, meters, alarms, or appliances contributed to the explosion.

The primary target of the recent lawsuit is Atmos Energy, the company responsible for striking the gas line. According to the lawsuit, Atmos Energy “Failed to properly monitor conditions” and “failed to warn” it client and others of the full risk of the natural gas leak.

Atmos’ did not respond to the suit directly, instead extending its condolences towards those harmed or killed in the explosion.
