A collision involving an SUV and an 18-wheeler left two people dead and another person injured on the Eastex Freeway in northeast Houston.

According to the Houston Police Department, the crash occurred at approximately 4:45 p.m. on Sunday, July 12, 2026, in the 15400 block of the Eastex Freeway, also known as North U.S. Highway 59. Local news reports placed the collision near the southbound exit to Beltway 8.

What Happened on the Eastex Freeway?

HPD reported that a dark-colored SUV was traveling southbound and attempting to exit the freeway when it made contact with a red Freightliner Cascadia 18-wheeler. The SUV then lost control, struck a barrier wall, and caught fire.

The SUV’s driver and one passenger were pronounced dead at the scene. A second passenger was transported to a Houston-area hospital. Authorities had not publicly identified the victims as of the initial report.

The 40-year-old truck driver was not injured. Police said he remained at the scene, showed no signs of impairment, and was questioned and released. The crash remains under investigation by HPD’s Vehicular Crimes Division.

Who Could Be Liable for the Crash?

HPD’s preliminary description does not make a final determination of fault. The fact that the truck driver was released without charges also does not resolve potential civil liability.

Investigators will likely need to examine the vehicles’ positions, speed, lane markings, turn signals, braking, available surveillance footage, witness statements, and whether either driver had an opportunity to avoid the collision. Fault could ultimately rest with one driver or be divided between multiple parties.

Commercial truck involvement can also introduce additional evidence, including dash-camera footage, electronic control module data, dispatch communications, and more. For more information on the types of evidence used in commercial truck cases, read our article here. Federal regulations generally require motor carriers to retain electronic logging-device records for at least six months, making early evidence-preservation efforts particularly important.

However, the involvement of an 18-wheeler does not automatically mean the truck driver or trucking company was responsible. Liability must be based on the evidence gathered during the investigation.

Can the Injured Passenger and Surviving Families Receive Compensation?

The hospitalized passenger may have a personal injury claim against whichever driver or company is ultimately found responsible. Because passengers generally do not control either vehicle, they may be able to pursue compensation even when investigators initially disagree about which driver caused the crash.

Texas law also permits the surviving spouse, children, and parents of a person killed through another party’s wrongful act or negligence to pursue a wrongful death claim. These cases may seek compensation for losses such as financial support, companionship, and mental anguish.

Texas generally imposes a two-year filing deadline on lawsuits involving personal injuries or death, although exceptions can affect when that period begins or expires.

Frequently Asked Questions About Eastex Freeway Truck Accidents

Who can be held liable after a crash involving an 18-wheeler?

Liability may fall on the truck driver, trucking company, another motorist, a maintenance provider, or multiple parties. Investigators must review the evidence before determining who caused or contributed to the collision.

Can an injured passenger file a personal injury claim?

Yes. An injured passenger may pursue compensation from the driver or company responsible for the crash. Passengers are generally not responsible for decisions made by either driver.

Does the truck driver being released without charges mean there is no civil claim?

No. Criminal charges and civil liability are separate matters. A driver or trucking company may still be financially responsible even when no arrest or traffic citation is issued.

What evidence is important after a commercial truck accident?

Important evidence may include police reports, witness statements, photographs, surveillance footage, dash-camera video, electronic logging records, vehicle data, maintenance records, and the truck driver’s employment history.

How long do families have to file a wrongful death lawsuit in Texas?

Texas generally allows two years from the date of death to file a wrongful death lawsuit. Certain exceptions may change the deadline, so families should seek legal guidance as soon as possible.
