Were You Seriously Injured by a Contract Drivers?

Walking through your own neighborhood should be the safest thing you do all day.

Every day in Houston, thousands of contract drivers race the clock for Amazon, UPS, FedEx, DoorDash, Instacart, and HelloFresh — timed, tracked, and scored on how many stops they can hit per hour. That pressure pushes drivers to speed, make rolling stops, and ignore road safety to reduce delivery times.

A delivery vehicle backing out blind, cutting a corner to save a few seconds, or double-parking where it hides you from oncoming traffic doesn’t just cause a fender bender. When there’s no seatbelt and no airbag between you and two tons of moving steel, the result is life-altering injuries — and Houston is now one of the deadliest cities in America for people on foot.

If you were struck while walking, in a crosswalk, in your own driveway, in an apartment complex or parking lot, or in your vehicle by a delivery van or contract driver, and you suffered serious injuries or needed hospitalization, your case is more complicated than it looks — because the company will say that driver doesn’t work for them.

Your well-being is our priority. We listen with respect, we’re committed to every case, and we fight for every dollar you need to recover.

What Kind of Commercial Truck Hit You?

A commercial truck is any motor vehicle used primarily to transport goods or passengers for business purposes. Due to their size, weight, and the nature of their cargo, accidents involving these vehicles often cause severe injuries and long-term damage.

    Amazon

Vehicles with a cab pulling a large trailer, commonly used for long-distance cargo hauling.

    Tankers

Specialized trucks carrying liquids or gases, like fuel or hazardous chemicals, posing risks of spills or explosions during collisions.

    UPS

Open trailers designed for oversized or irregular cargo, where improperly secured loads can shift or fall onto the road.

    FEDEX

Enclosed vehicles used for transporting packaged goods, with risks including cargo shifts and rear-end collisions.

    Meal Prep Delivery

Commercial vehicles used in construction to mix heavy materials such as cement and concrete.

    Material Delivery

Used in construction and hauling bulk materials; accidents often involve tipping loads or inadequate braking.

Each of these vehicles poses unique risks, especially when operated negligently or without proper maintenance. Then there’s the cargo, which can also increase the danger and the damage; especially if it’s flammable, caustic, or toxic.

What Type of Accident Was It?

Delivery vehicles do their damage in the places people live and walk — residential streets, driveways, apartment complexes, and parking lots. Even at low speed, that’s enough to cause catastrophic injuries.

The Law Offices of Hilda Sibrian represents people hurt in every kind of delivery and contract driver crash, including:

    • Pedestrians struck in crosswalks or intersections
    • Backing and reversing accidents in driveways
    • Pedestrians hit in apartment complexes or parking lots
    • Children struck on residential streets
    • Double-parked vans blocking sightlines
    • Rear-end collisions and rolling stops
    • Distracted driving — apps, scanners, and navigation
    • Hit-and-run and unidentified delivery drivers

Each of these can leave you with permanent injuries, medical bills you never agreed to, and a life that doesn’t work the way it did last week. Our legal team knows how these companies operate — and we fight to make sure the pressure they put on their drivers doesn’t become your burden to carry.

Delivery Traffic is on the Rise. So Are the Crashes.

Every year, more delivery vehicles run more routes through Houston neighborhoods than the year before. These aren’t crashes on the interstate. They happen on the street where you live, at the speed and in the places where people on foot have no protection at all.

Houston has become one of the deadliest cities in the country for pedestrians — third in the nation by federal data. In 2025, 99 pedestrians were killed on Houston roadways. Most serious delivery crashes trace back to negligence by the driver, the contractor, or the company setting the quota. Common causes include:

    • Stop-count pressure, where drivers are timed and scored on how many deliveries they complete per hour.
    • Blind-zone backing, from cargo vans reversing out of driveways and breezeways with no spotter and no working camera.
    • Distraction by design, as route apps, scanners, photo confirmations, and customer messages compete for attention that belongs on the road.
    • Untrained and seasonal drivers, hired in a rush during peak season and put on unfamiliar residential routes.
    • Neglected contractor fleets, where maintenance, brakes, mirrors, and backup cameras are somebody else’s line item.

These aren’t accidents in the true sense of the word. They’re the predictable result of a business model that treats speed as the priority and safety as the cost.

If you or someone you love was hit by a delivery or contract driver — whether you were walking, on a bike, or in your vehicle — you have the right to pursue compensation for your medical bills, lost wages, physical pain, and emotional suffering.

Delivery cases are not regular crashes. You aren’t up against one driver — you’re up against a national corporation, a contracting company, and two or three insurance carriers, all of whom start protecting themselves the same day it happens. Their first move is almost always the same: “That driver doesn’t work for us.”

If you don’t have a legal team that knows how these companies are built, you run the risk of:

    • Losing key evidence, like GPS data, route logs, and camera footage that overwrite in days

    • Getting blamed yourself, especially if you were on foot and couldn’t tell your side at the scene

    • Accepting an unfair settlement before anyone knows what your injuries will actually cost

    • Overlooking the real parties at fault, such as the delivery platform, the contracting company, or the fleet owner

With Hilda Sibrian, you’re not alone. We take care of:

    • Preserving the company’s data before it disappears
    • Investigating what the driver’s app was doing at the exact moment of impact
    • Identifying every company and every policy that owes you
    • Challenging a police report that got it wrong
    • Calculating the real value of your damages, including emotional pain and long-term quality of life
    • Negotiating directly with the insurance companies, so you never have to

We keep you informed along the way. Every step, we take it with you and for you.

Frequently Asked Questions About 18-Wheeler Truck Accidents in Houston

Q: Who pays if an Amazon delivery driver hits me in Houston?

A: It depends on which kind of Amazon driver hit you. Branded blue vans are usually operated by a Delivery Service Partner (DSP) — a separate contracting company with its own commercial insurance policy. Amazon Flex drivers use their own personal cars and are covered by an Amazon commercial auto policy, but generally only while they’re actively delivering. Which structure applies is one of the first things we investigate, and it can change the amount of compensation available to you by a factor of ten.

Q: Can I sue DoorDash, Uber Eats, or Instacart if their driver hit me?

A: Often, yes — but not in the way most people expect. These platforms classify most drivers as independent contractors specifically to limit their own exposure. That doesn’t leave you without a claim. Platform commercial coverage frequently applies during an active delivery, and there may be additional policies and responsible parties behind the driver. This is exactly the kind of case where calling a lawyer early changes the outcome.

Q: The delivery driver said they’re an independent contractor. Does that mean I can’t recover anything?

A: No. “Independent contractor” is a business arrangement between the driver and the company — it is not a shield that erases your right to compensation. There is almost always insurance somewhere: the driver’s policy, the platform’s commercial policy, the contracting company’s coverage, or your own uninsured motorist coverage. Our job is to find every one of them.

Q: I was hit by a delivery van while walking. What are my rights in Texas?

A: Texas drivers have a legal duty to yield to pedestrians in marked and unmarked crosswalks, and since 2021 the Lisa Torry Smith Act has made it a felony to seriously injure or kill a person in a crosswalk. You have the right to pursue compensation for medical care, lost income, pain, disfigurement, and long-term effects — regardless of whether the driver is charged criminally.

Q: The police report says the accident was my fault. Do I still have a case?

A: Very possibly. A police report is an initial opinion, not a final ruling — and it’s often written when the injured pedestrian is unconscious or in an ambulance and can’t give their side. In Houston, more than 70% of pedestrian deaths are attributed to the pedestrian failing to yield. We regularly challenge those findings using GPS data, telematics, video, and the delivery company’s own route records.

Q: What if I was partly at fault?

A: You can still recover under Texas’s proportionate responsibility rule as long as you are not found more than 50% at fault. Your recovery is reduced by your share of the blame — which is exactly why fighting an unfair fault assignment matters so much, and why you shouldn’t accept the first version of the story.

Q: The delivery driver drove off. Can I still recover anything?

A: Often yes. Delivery vehicles leave a data trail that ordinary hit-and-run drivers don’t — route logs, GPS pings, scan timestamps, and photo-confirmation records can identify a driver even with no plate number. Your own uninsured motorist coverage may also apply. Call before you assume nothing can be done.

Q: How long do I have to file a claim in Texas?

A: Generally two years from the date of the crash, with important exceptions — and much shorter notice deadlines if a government vehicle or entity is involved. But the real deadline is earlier than that: route data, dash footage, and doorbell video can be overwritten in a matter of days.

Q: What evidence matters most in a delivery driver case?

A: The company’s own records. GPS and telematics showing speed and braking, app status logs showing what the driver was doing at the moment of impact, route assignments and stop counts, scanner timestamps, in-cab camera footage, and nearby doorbell or business surveillance video. We send preservation letters immediately so this evidence can’t quietly disappear.

Q: The insurance company already offered me a check. Should I take it?

A: Don’t sign anything first. Early offers arrive before anyone knows what your injuries will actually cost, and accepting one typically closes your claim permanently — including for surgeries you don’t know you need yet. We’ll review any offer at no cost.

Q: Do I have to talk to the delivery company’s insurance adjuster?

A: No. You are not required to give a recorded statement to the other side’s insurance company, and doing so rarely helps you. Adjusters are trained to ask questions that produce answers they can use later. Let us handle that conversation.

Q: What should I do right now, today?

A: Get medical attention, even if you feel okay — brain and internal injuries can take days to surface. Photograph the vehicle, plate, company logo, street, and your injuries. Ask neighbors and nearby businesses to save their camera footage before it overwrites. Don’t give a recorded statement. Then call us at 713-714-1414.

Q: What does it cost to hire the Law Offices of Hilda Sibrian?

A: Nothing upfront. We work on a contingency fee — we’re paid only if we recover compensation for you, and our fee comes out of the recovery rather than your pocket.*

    Q: Can I have a case if I don’t have papers or a driver’s license?

A: Yes. Your right to compensation for someone else’s negligence does not depend on your immigration status. We have helped many families in exactly that situation, and we will help yours.

Q: How much is my case worth?

A: Every case is different, and no honest attorney will quote a number over the phone. What we can do is calculate the full value of what this cost you — medical expenses, lost income, physical pain, emotional trauma, disfigurement, and long-term effects on your life — including the parts insurers routinely leave out.
