The incident highlights a danger that reaches well beyond construction: everyday maintenance and installation work can place someone high above the ground, dependent on equipment and safeguards arranged and managed by others.

For Houston workers installing signs, trimming trees, repairing buildings or servicing industrial equipment, safe lift operation starts before the platform rises. After a serious accident, those same preparations help explain what went wrong and who may be legally responsible.

On this page

What happened at Bass Pro Shops in Leeds?

Bucket lifts, boom lifts and scissor lifts

What makes bucket lifts dangerous?

What fall protection and safety measures are needed?

Who may be liable in Texas?

What evidence matters after a lift accident?

Frequently asked questions

Help for Houston workers and families

What happened at Bass Pro Shops in Leeds?

Local news reported that a 70-year-old man died Sunday, Oct. 18, after falling from a lift while working on lights at Bass Pro Shop in Leeds, Alabama. Leeds police said he died at the scene.

Seasonal decorating is one of many jobs that require elevated access. The equipment still needs a safe setup, an operator prepared for the task and fall protection suited to the lift. Unfortunately, many workers become complacent when working in the lift, or in supporting their lifted workers.

Bucket lifts, boom lifts and scissor lifts: Why the difference matters

Workers may use “bucket lift,” “cherry picker” or “manlift” to describe different machines. Proper guardrails are central to fall protection.

A safety rule for one machine should not be applied to another simply because both lift people.

What makes bucket lifts dangerous?

Falls and ejection from the platform

An open entry gate, climbing on the basket or reaching beyond the platform can expose a worker to a fall. A sudden jolt can also throw someone out while the machine remains upright.

Lift manufacturer Genie warns that a small jar at the base can produce a powerful whipping motion at the platform. A worker can therefore be ejected without the boom breaking or the entire lift tipping over.

Tip-overs and unstable ground

Holes, slopes, soft ground and unsupported edges can undermine stability. Overloading the platform or operating in wind beyond the manufacturer’s limits adds danger. The load includes people, tools and materials.

For a lift with outriggers, the support beneath them matters. Setting a foot on weak ground does not make the equipment stable just because the outrigger has been extended.

Crushing against overhead structures

A worker can be pinned between the basket and a beam, ceiling, sign or building overhang. The danger exists even when the worker never leaves the platform. Planning the basket’s route includes checking the space around and above the person operating it.

Electrical contact

Overhead power lines threaten crews doing many kinds of work. A lift used for tree trimming, communications work or building maintenance can bring equipment or a worker close to energized lines.

Our recent coverage of a fatal bucket truck electrocution in Houston’s Acres Homes neighborhood explains that electrical exposure. An insulated bucket has limits and does not make every contact with electrical equipment safe.

Collisions and falling objects

Another lift, forklift or vehicle can strike the machine’s base or boom. Tools and materials can also fall onto people below. A work area that remains open to moving vehicles or pedestrians needs controls for those exposures, as well as safeguards for the person in the basket.

What fall protection and safety measures are needed?

Harnesses are one part of a complete system

OSHA’s construction aerial-lift guidance calls for workers to remain tied off while working from the lift. The familiar “six-foot construction fall” rule is not a general permission to work untethered in an aerial lift below that height.

Two approaches serve different purposes:

Fall restraint: The connection is arranged to prevent the worker from falling out.

Fall arrest: The system stops a fall after it begins. It requires a full-body harness, suitable anchorage and enough clearance to avoid striking the ground or another lower level.

The lift also needs to withstand the forces of an arrested fall. A long lanyard attached to an unsuitable point may leave a worker exposed despite wearing a harness. The complete setup deserves review: the harness, connector, attachment point, available clearance and equipment instructions. A body belt is not acceptable for arresting a fall.

Scissor lifts have different rules. OSHA emphasizes compliant guardrails, standing on the platform floor and keeping the work within reach. The applicable standard and the machine’s instructions determine whether additional personal fall protection is needed.

Inspection and training need to match the job

OSHA’s general-industry aerial-lift rule calls for daily control testing and trained operators. Construction requirements also address daily testing and authorized operation. Training should prepare the operator to recognize hazards and use the actual equipment safely.

Before elevation, the work plan should address:

The lift’s reach and capacity for the assigned task.

Ground support, slopes, weather and overhead obstructions.

Working controls, gates, safety devices and fall-protection equipment.

Separation from traffic and people below the work.

Workers should stand on the basket floor. OSHA prohibits using ladders or planks inside the basket to gain height and tying off to an adjacent pole or structure. If the platform cannot safely reach the task, the setup needs to change.

Emergency lowering and rescue need advance planning

For construction work using a fall-arrest system, OSHA requires prompt rescue or the ability to self-rescue. Stopping a fall can leave someone suspended outside the basket.

A practical plan identifies who can operate the emergency controls, how that person can reach them and how rescuers will communicate with the worker. Lowering the platform and recovering a suspended person may require different actions. Those questions should be answered before an emergency.

Who may be liable for a bucket lift accident in Texas?

A negligence claim examines the defendant’s legal duty, what the defendant did or failed to do, how that conduct caused the injury and the resulting losses. Several companies may be involved in a lift job, but each company’s responsibility needs its own analysis.

The worker’s employer

Employer coverage changes the available claim. A Texas employer with applicable workers’ comp coverage generally has protection from an employee’s ordinary negligence lawsuit. A narrow exception preserves exemplary-damages claims by a deceased worker’s surviving spouse or descendants when the employer’s gross negligence or intentional conduct caused the death.

An employer without workers’ comp coverage, often called a non-subscriber, may face a negligence lawsuit over unsafe equipment, inadequate training or other failures that caused the injury.

Texas Labor Code Section 406.033 restricts a non-subscriber’s defenses, including contributory negligence, assumption of risk and negligence by a fellow employee. The worker still needs to prove negligence by the employer or its agent acting within the scope of employment.

A separate contractor or equipment operator

Another company may create the danger by striking the lift, operating nearby equipment carelessly or directing work unsafely. Texas law allows a claim against a legally responsible third party even when the worker receives workers’ comp benefits. The insurer may have reimbursement rights affecting a recovery.

A separate company name does not always establish third-party status. Under Labor Code Section 406.123, a qualifying coverage agreement can make a general contractor the statutory employer of a subcontractor’s employees for workers’ comp purposes. Those agreements deserve review before identifying potential defendants.

Supervisory responsibility requires closer review. In JLB Builders v. Hernandez, the Texas Supreme Court explained that a general contractor’s duty to a subcontractor’s employee can depend on actual or contractual control over the work that caused the injury. Being the general contractor, setting deadlines or receiving progress reports does not automatically establish control over the dangerous activity.

A lift rental company or maintenance contractor

A rented lift can raise questions about inspection, repair and known operating problems. If a company negligently serviced the equipment or supplied it in an unsafe condition, that conduct may support a claim when it caused the accident.

Rental agreements, repair orders and reports of earlier malfunctions help show what each business undertook to do and what it knew. The name on the machine alone does not establish liability.

A commercial property owner

A store, warehouse or industrial facility does not automatically become liable because the accident occurred on its property. The owner’s role, the source of the hazard and the nature of the work matter.

Texas Civil Practice and Remedies Code Chapter 95 can apply to certain contractor claims arising from the condition or use of an improvement the contractor is constructing, repairing, renovating or modifying. When it applies, owner liability generally requires both control over how the work was performed and actual knowledge of the injury-causing danger with a failure to adequately warn.

A general right to stop work or inspect progress is insufficient under that control requirement. Applying Chapter 95 requires examining the actual task and improvement involved; it is not a blanket rule for every maintenance or decorating accident.

How OSHA findings fit into a civil case

Safety standards and inspection findings can help evaluate the work practices involved. An OSHA citation does not automatically establish every element of a Texas negligence claim, and OSHA does not itself create a private damages lawsuit. The civil case still requires proof connecting a legally responsible defendant’s conduct to the injury.

What evidence matters after a lift accident?

Begin with emergency care and keeping others away from unstable equipment or electrical hazards. Once the scene is safe, evidence preservation can help explain the lift’s condition and the work being performed.

The lift and identifying information: Model, serial number, rental number and photographs of its position, controls and support points.

The fall-protection system: Harness, lanyard or lifeline, connectors, attachment point and their condition.

Video and witnesses: Store surveillance, nearby cameras, vehicle footage and names of people who saw the setup or accident.

Equipment history: Inspection records, repair orders, earlier complaints and available electronic operating data.

Work records: Contracts, work orders, training records, hazard assessments and instructions identifying who directed the task.

A preservation request should address the equipment and related records before repairs, return to a rental fleet or video deletion. Any inspection or testing should be coordinated so the evidence remains available to evaluate what happened.

These questions also arise in construction accident cases and industrial workplace injury claims, where multiple crews may share a work area.

Frequently asked questions

Can someone fall from a bucket lift without the lift tipping over?

Yes. A sudden movement can eject a worker while the machine remains upright. Gate condition, footing and personal fall protection also matter.

Do boom lifts and scissor lifts have the same harness rules?

No. OSHA treats boom-type aerial lifts and scissor lifts differently. Boom-lift workers need appropriate personal fall protection; scissor-lift requirements emphasize compliant guardrails. Review the machine, task, applicable standard and manufacturer’s instructions.

Does being a contractor prevent a claim against another company?

No. A contractor may have a claim against a separate business whose negligence caused the injury. The review should establish each party’s legal role, duty and conduct. A commercial property owner may have additional protections under Texas law.

What if the company says the worker caused the fall?

The evidence matters. In third-party claims governed by Texas proportionate-responsibility law, a worker’s share of fault can reduce damages and a share greater than 50% bars recovery. Claims against non-subscriber employers follow different rules, including restrictions on using the employee’s contributory negligence as a defense.

Help for Houston workers and families

After a serious lift accident, the questions come quickly: who was responsible, whether workers’ comp applies and what evidence might disappear. Deadlines matter. Texas personal injury and wrongful death claims generally must be filed within two years, though exceptions can apply. Workers’ comp has its own notice and filing deadlines. Waiting can jeopardize a valid claim, so an early review is worthwhile.

The Law Offices of Hilda Sibrian reviews third-party and non-subscriber claims involving serious workplace injuries.
