Companies must confirm drivers are at least 18 with a valid license, must conduct criminal background checks, and must pull their driving record before authorizing platform access. Anyone with a DWI conviction in the past seven years or more than four moving violations in the past three years must be barred. It must also adopt and publish a zero-intoxication policy in line with commercial truck laws and provide a complaint channel.<\/p>\n<p>While this may sound like a lot, the restrictions around delivery companies are generally lighter than Texas&#8217;s rideshare laws in a few key places. The most important of these rules is that the rideshare (not delivery) statute requires companies to investigate a complaints of intoxicated drivers and immediately suspend the driver during that investigation. The provision laid out in the delivery statute does not require this suspension; only that customers can complain and that the company adopt (at least in name) a &#8216;zero-intoxication&#8217; policy.<\/p>\n<hr \/>\n<p style=\"text-align: right\"><a href=\"#top\">Back to Top<\/a><\/p>\n<h2 id=\"insurance-gap\">Why the delivery law still leaves a gap between insurance minimums<\/h2>\n<p>Texas drew a real distinction between passenger rides and deliveries. Its rideshare statute expressly applies <a href=\"https:\/\/statutes.capitol.texas.gov\/Docs\/IN\/pdf\/IN.1954.pdf\">Chapter 1954 of the Texas Insurance Code<\/a> to transportation network companies, setting a minimum coverage floor. The delivery-network chapter added in 2025 contains no parallel requirement.<\/p>\n<p>That doesn&#8217;t mean DoorDash, Uber and similar companies carry no delivery coverage. They publish their own coverage terms, and whatever policy is in force on the crash date controls.
