This case is extremely important because it will affect how courts across the country handle warning-label lawsuits involving federally regulated products.<\/p>\n<p>The case in question is <em>Monsanto Company v. John L. Durnell<\/em>, and the Supreme Court has agreed to decide whether the Federal Insecticide, Fungicide, and Rodenticide Act, known as FIFRA, blocks a state-law failure-to-warn claim when the Environmental Protection Agency has not required the warning at issue. The lawsuits center on glyphosate, Roundup\u2019s active ingredient, and claims that exposure to Roundup can cause non-Hodgkin lymphoma, a type of cancer.<\/p>\n<p>The case before the Supreme Court involves John Durnell, a Missouri groundskeeper who alleged that he developed non-Hodgkin lymphoma after years of Roundup exposure. A Missouri jury awarded him $1.25 million on a failure-to-warn claim, and Monsanto appealed.<\/p>\n<p>Importantly, the Supreme Court is <strong>not directly deciding whether Roundup causes cancer<\/strong>. The central issue here is specifically about whether federal pesticide labeling law prevents injured people from bringing state-law lawsuits claiming that Monsanto should have included a cancer warning.<\/p>\n<p style=\"text-align: right\"><a href=\"#top\">Back to Top<\/a><\/p>\n<hr \/>\n<p><a name=\"federal_preemption\"><\/a><\/p>\n<h2>The Key Legal Issue: Federal Preemption<\/h2>\n<p>The case turns on a doctrine called <strong>federal preemption<\/strong>. In general, preemption asks whether federal law overrides state law. If this sounds familiar, it&#8217;s because our article <a href=\"https:\/\/hildasibrian.com\/en\/blog\/supreme-court-rules-against-unqualified-carriers\/\" target=\"_blank\" rel=\"noopener\">earlier this week<\/a> on trucking brokers also evaluated federal preemption &#8211; but for commercial interstate transport. Because the Supreme Court is the &#8220;last say,&#8221; it is often the only entity that can decide whether the state or the federal government should take precedent. The current conservative majority of the court means that it often sides with state rights, not the federal government.<\/p>\n<p>Monsanto argues that FIFRA gives the EPA authority over pesticide labels and that state-law claims requiring a cancer warning would conflict with the EPA\u2019s approval of Roundup labels without that warning. In its Supreme Court briefing, Monsanto argues that the EPA has repeatedly concluded that glyphosate does not cause cancer and has approved Roundup labels without a cancer warning.<\/p>\n<p>Durnell\u2019s side argues that EPA registration is not supposed to give a manufacturer complete immunity from state-law warning claims. His brief points to FIFRA language stating that registration is not a defense for selling or distributing a misbranded pesticide, and argues that Missouri failure-to-warn law does not add to federal law but instead parallels FIFRA\u2019s own prohibition on misleading or inadequate labeling.<\/p>\n<p>That distinction matters. If the Court agrees with Monsanto, many Roundup failure-to-warn claims could become much harder to bring. If the Court agrees with Durnell, state juries may continue to play a role in deciding whether federally approved labels are legally inadequate under state law.<\/p>\n<p style=\"text-align: right\"><a href=\"#top\">Back to Top<\/a><\/p>\n<hr \/>\n<p><a name=\"why_matters\"><\/a><\/p>\n<h2>Why the Case Matters Beyond Roundup<\/h2>\n<p>This case is being watched closely because it could affect thousands of existing and future claims. Reuters reported that Bayer faces claims from about 65,000 Roundup plaintiffs in the United States, while also pursuing a proposed $7.25 billion settlement structure for current and future claims.<\/p>\n<p>A ruling for Monsanto could limit label-based claims involving pesticides when the EPA has not required a specific warning. More broadly, it could influence how courts think about the relationship between federal regulation and state personal injury lawsuits.<\/p>\n<p>A ruling for Durnell would preserve a stronger role for state tort law. That would mean federal approval of a product label does not automatically end the question of whether the label gave consumers adequate warnings.<\/p>\n<p style=\"text-align: right\"><a href=\"#top\">Back to Top<\/a><\/p>\n<hr \/>\n<p><a name=\"monsanto_papers\"><\/a><\/p>\n<h2>The Monsanto Papers and Why They May Undermine the Company\u2019s Case<\/h2>\n<p>One reason the Roundup litigation remains so controversial is the <a href=\"https:\/\/usrtk.org\/monsanto-papers\/\" target=\"_blank\" rel=\"noopener noreferrer\">public 2017 release<\/a> of internal Monsanto documents commonly known as the <strong>\u201cMonsanto Papers.\u201d<\/strong> These documents came out through discovery in earlier Roundup lawsuits and included internal communications about Monsanto\u2019s role in shaping scientific literature used to defend glyphosate and Roundup. One document archive describes the materials as including records about the company\u2019s <strong>alleged ghostwriting<\/strong> of a 2000 paper and its later use of that \u201cindependent\u201d literature to promote and defend its herbicides. This paper, &#8220;<em>Safety evaluation and risk assessment of the herbicide Roundup and its active ingredient, glyphosate, for humans<\/em>&#8221; may be the single most cited article on glyphosate when discussing whether or not the compound causes cancer.<\/p>\n<p>That history may complicate Monsanto\u2019s position before the Supreme Court. Monsanto\u2019s legal argument focuses on federal preemption: because the EPA did not require a cancer warning on Roundup\u2019s label, the company argues that state-law failure-to-warn claims should be barred. The Supreme Court granted review on the specific question of whether FIFRA preempts a label-based failure-to-warn claim where EPA has not required the warning.<\/p>\n<p>The problem for Monsanto is that the Monsanto Papers raise a broader trust issue: whether regulators, courts, juries, and the public were evaluating a truly independent scientific record. In 2025, the journal <em>Regulatory Toxicology and Pharmacology<\/em> retracted the previously mentioned paper. The reasons for retraction include author independence, conflicts of interest, and the integrity of the carcinogenicity analysis. Reporting on the retraction noted that internal Monsanto documents had revealed company influence over the paper and that the paper had been used for years to support the position that glyphosate did not pose a cancer risk.<\/p>\n<blockquote style=\"background: #f9f9f9;border-left: 10px solid #ccc;margin: 1.5em 10px;padding: 0.5em 10px\"><p>In one email, a Monsanto employee proposed \u201ckeeping the cost down\u201d to produce a scientific paper with outside scientists \u201cby us doing the writing and they would just edit &amp;amp; sign their names so to speak. Recall that is how we handled Williams Kroes &amp;amp; Munro, 2000.\u201d \u2014 <a href=\"https:\/\/retractionwatch.com\/2025\/12\/04\/glyphosate-safety-article-retracted-elsevier-monsanto-ghostwriting\/\" target=\"_blank\" rel=\"noopener noreferrer\">RetractionWatch,<\/a> Dec. 5, 2025<\/p><\/blockquote>\n<p>However, while important, Monsanto&#8217;s possible involvement in generating ghost papers do not automatically decide the Supreme Court case. The justices are not directly deciding whether Roundup causes cancer, nor are they conducting a trial on Monsanto\u2019s internal conduct. The legal issue is specifically whether federal pesticide labeling law prevents state-law warning claims. That being said, the Monsanto Papers may still matter because they undercut the practical fairness of treating EPA label approval as the final word. If the scientific record presented to regulators was shaped, influenced, or selectively framed by the manufacturer, plaintiffs can argue that federal approval should not become an automatic shield against liability.<\/p>\n<p style=\"text-align: right\"><a href=\"#top\">Back to Top<\/a><\/p>\n<hr \/>\n<p><a name=\"epa_role\"><\/a><\/p>\n<h2>The EPA\u2019s Role and the Ongoing Scientific Dispute<\/h2>\n<p>The EPA currently states that it does not agree with the International Agency for Research on Cancer\u2019s conclusion that glyphosate is \u201cprobably carcinogenic to humans,\u201d and the agency has said glyphosate is not likely to be carcinogenic to humans.<\/p>\n<p>At the same time, the regulatory history is not simple. In 2022, the Ninth Circuit vacated the human-health portion of EPA\u2019s glyphosate interim decision, and EPA later withdrew that interim decision while stating that its underlying scientific findings remained the same and that it would revisit and better explain its cancer-risk evaluation.<\/p>\n<p>That tension is part of what makes this case so significant. The Supreme Court is being asked to decide how much weight EPA labeling decisions should carry when injured people argue that a warning was still legally required.<\/p>\n<p style=\"text-align: right\"><a href=\"#top\">Back to Top<\/a><\/p>\n<hr \/>\n<p><a name=\"injury_lawyers\"><\/a><\/p>\n<h2>Why Personal Injury Lawyers Are Paying Attention<\/h2>\n<p>Even though this is a product liability case, the issues are familiar in many injury cases: warnings, safety rules, corporate responsibility, regulatory compliance, and the right of injured people to present evidence in court.<\/p>\n<p>In many injury cases, defendants argue that compliance with a regulation should protect them from liability. Plaintiffs often respond that minimum regulatory compliance does not always mean reasonable care was used.
