According to reports published April 20, 2026, the verdict followed a two-week trial in Starr County and included findings that Upton Assets was 100% responsible for the deaths and that its conduct amounted to gross negligence.<\/p>\n<p>The case arose from an explosion on October 7, 2023, at the company\u2019s hazardous-chemicals facility in Pecos. Local reporting at the time said Pecos police and emergency responders were dispatched around 10:14 a.m. after a tank exploded. Two workers died at the scene.<\/p>\n<h2>Who Were the Workers Killed in the Explosion?<\/h2>\n<p>The men killed were identified as Reinaldo Garcia Pena, 57, and Angel Alaffa, 30. Plaintiffs alleged that Upton Assets:<\/p>\n<ol>\n<li>Hired a crew of 8 workers without conducting any due diligence into their qualifications<\/li>\n<li>Never trained or oriented those workers<\/li>\n<li>Provided the workers with a gas monitor &#8220;incapable of detecting the very vapors that would cause the explosion<\/li>\n<\/ol>\n<p>In addition, plaintiffs alleged that the president of Upton Assets:<\/p>\n<ol>\n<li>Never read the federal safety standards for his facility<\/li>\n<li>Could not identify a single employee that had read those standards<\/li>\n<li>Had no degree, PSM certification and had never completed &#8220;a single OSHA PSM course&#8221;<\/li>\n<\/ol>\n<p>The jury agreed with the plaintiffs claims that Upton Assets operated negligently and with total disregard to workers safety. This is reflected in the size of the award &#8211; a billion dollar verdict.<\/p>\n<h2>Why Process Safety Management Matters<\/h2>\n<p>That matters because the Pecos facility was described in the coverage as a Process Safety Management (PSM) facility. OSHA\u2019s PSM standard is designed to prevent or minimize catastrophic releases of flammable, explosive, or toxic chemicals. Among other things, the standard requires employers to implement programs to identify, evaluate, and control these hazards, and it specifically requires a hot work permit for hot work operations conducted on or near a covered process.<\/p>\n<p>In other words, this was not a case involving an ordinary workplace hazard. It involved a facility operating in a heavily regulated environment where ignition sources, flammable vapors, contractor oversight, and written safety procedures are central to preventing exactly this kind of disaster. OSHA says the purpose of the PSM rule is to prevent catastrophic releases that can cause fires and explosions.<\/p>\n<h2>What Happens Now<\/h2>\n<p>The headline number is enormous, but the final amount the company ultimately owes may still change. Post-trial motions and appeals are common in major wrongful death cases, especially when a verdict includes substantial exemplary or punitive damages. In this case, punitive damages were awarded at 3 times the compensation amount.
