In a truck case, the liable parties could include the driver, the dispatcher, the loading crew, or others. There is rarely a single party who is entirely responsible for your injury; very often the injury is caused by &#8220;<a href=\"https:\/\/hildasibrian.com\/en\/blog\/third-party-liability-in-personal-injury-cases\/\" target=\"_blank\" rel=\"noopener\">third-party liability<\/a>.&#8221;<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7bf64db elementor-widget elementor-widget-text-editor\" data-id=\"7bf64db\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<h3>Damages<\/h3><p>How do you determine the \u201ccost\u201d of an injury and the damages? The answer is both simple and complex.<\/p><p>One the one hand, you have &#8220;<a href=\"https:\/\/hildasibrian.com\/en\/blog\/economic-vs-non-economic-damages\/\" target=\"_blank\" rel=\"noopener\">economic damages<\/a>&#8221; or financial consequences, in plain english.<\/p><p>These can include:<\/p><ul><li>Medical bills<\/li><li>Lost wages<\/li><li>Future medical care<\/li><li>Inability to work<\/li><\/ul><p>On the other hand, you also have &#8220;non-economic damages&#8221;, or personal consequences.<\/p><p>These can include:<\/p><ul><li>Not being able to enjoy previous hobbies<\/li><li>Being unable to have children<\/li><li>Loss of companionship<\/li><li>Pain and Suffering<\/li><li>Scarring and disfigurement<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-942be34 elementor-widget elementor-widget-text-editor\" data-id=\"942be34\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<h3>Evidence<\/h3><p>Once you have established liability and start sorting out how you&#8217;ve been harmed, you need to be able to <strong>prove it<\/strong>!<\/p><p>The evidence used in personal injury cases can be broken down into two categories: <strong>physical<\/strong> and <strong>testimonial<\/strong>. Any video, document, or photo that objectively supports your claim is considered physical evidence, while any statement from a friend, family member, colleague, coach, or eyewitness is considered testimonial.\u00a0<\/p><p>In general, physical evidence is much stronger than testimonial evidence, because it is objective. Physicaly evidence is usually used to determine the <strong>facts<\/strong> of the case &#8211; what really happened, and how. The more objective support you have, the stronger your case will be.\u00a0<\/p><p>As a note, this is why we recommend\u00a0<strong>everyone <\/strong>have a dashcam! Most individuals simply do not have the cash to support paying out a personal injury settlement, and end up filing for bankruptsy with little recourse.<\/p><p>Companies are a little different. When a company files for bankruptcy, like\u00a0TPC group after their <a href=\"https:\/\/hildasibrian.com\/en\/blog\/oilgas-accident-history\/\" target=\"_blank\" rel=\"noopener\">Port Neches explosion in 2019<\/a>, plaintiffs have a few options. Typically, this means that you become an &#8220;unsecured creditor&#8221; &#8211; meaning they owe you money, but haven&#8217;t said where it will come from.<\/p><p>Collecting money from companies that declare bankruptcy (unless it&#8217;s clear they did so just for <b>your<\/b>\u00a0lawsuit) takes years, if you ever see a penny. There are a few reasons for this, but the primary one is that companies <strong>do not\u00a0<\/strong>want the public to know:<\/p><ol><li>That they have hurt or killed someone due to their own negligence and<\/li><li>How much they paid as a result of their recklessness or negligence.<\/li><\/ol><p>As such, confidentiality is a big part of settlements. That being said, companies must also <strong>earn<\/strong> confidentiality; one of the perks of having a strong case is the ability to ask for more money in return for not exposing the company.\u00a0\u00a0<\/p><p>The following are a number of high-profile and open-and-shut cases that went to trial due to failed mediation or insurance companies refusing to work with the victim.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-92bec8e e-con-full e-flex e-con e-child\" data-id=\"92bec8e\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-2006462 elementor-widget elementor-widget-text-editor\" data-id=\"2006462\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<h3>The Oak Tree Settlement<\/h3><p>In 1984, a previous Attorney General and now-governor of Texas was <a href=\"https:\/\/www.texastribune.org\/2002\/02\/18\/greg-abbott-as-plaintiff\/\" target=\"_blank\" rel=\"noopener\">struck by a tree trunk<\/a> that snapped and fell while he was running. The 75-foot tree knocked him down, broke his back and ribs, and ultimately left him paralyzed from the waist down.<\/p><p>The victim then sued the owner of the tree and the tree-trimming company that had worked on it, settling the case for an open amount that has paid at least $5 million so far.<\/p><p><strong>What Makes This Case So Strong?<\/strong><\/p><ol><li><strong>Liability <\/strong>&#8211; Homeowners are responsible for their property; failing to maintain the massive tree on one&#8217;s property (especially to the point where its trunk can split!) is a clear violation of that duty. Similarly, this liability extends to the company paid to take care of this tree, as it is their duty to ensure the tree is safe <strong>or <\/strong>to warn the homeowner that it may not be. Some may argue that the trimming company has <em>more\u00a0<\/em>liability than the homeowner, as they are the ones knowledgable enough to say if the tree is safe or not.<\/li><li><strong>Damages\/Compensation <\/strong>&#8211; The damages here are obviously severe, as is the need for compensation. The victim suffered immediate medical bills related to his broken back, ribs and legs,\u00a0 as well as rehabilitation that would continue for the rest of his life. There is also a strong case for emotional suffering and a forced change to his lifestyle. Being paralyzed is incredibly traumatizing, and the fact that the victim was running when the injury occurred only helped to strengthen his claim that the injury was life-shaping.<\/li><li><strong>Evidence\u00a0<\/strong>&#8211; Physically, there are no recordings of the accident, as there sometimes are not. However, the victim may have been able to rely on hospital records that show his injury was consistent with a tree falling on him, as well as the fact that two cars were totalled when the tree fell on him. Additionally, it is not unwise to assume at least one person saw the victim in his state, be that EMS or another homeowner.<\/li><li><strong>Collectability\u00a0<\/strong>&#8211; This aspect is a little trickier &#8211; it&#8217;s hard to know the status of the homeowner. However, the victim also sued the tree-trimming company, who would likely either have insurance or be able to afford compensation payments.<\/li><\/ol><h3>Laura Lopez et al. vs. Frito-Lay, Inc. et al<\/h3><p>Hernan Murillo died after falling to his death in 2019 while conducting electrical work. Murillo fell from his scissor lift after being struck by a separate boom lift that backed into him.<\/p><p>The jury awarded his surviving spouse, Laura Lopez, $72 million, aportioned across Walker Engineering (65%) and Walker Industrial (35%).<\/p><p><strong>What Makes This Case So Strong?<\/strong><\/p><ol><li><strong>Liability: <\/strong>One of the key questions at trial was whether or not Murillo improperly placed his scissor lift too close to the boom lift that killed him. The answer, according to the jury after a 15-day trial, is that it doesn&#8217;t matter. The operator of the boom lift was untrained and unqualified to have operated the boom lift, and that Walker Engineering should never have allowed him to do so in the first place. Additionally, Walker Engineering&#8217;s arguments that the worker belonged to a different company, Walker Industrial, were also largely irrelevant because Walker Engineering is still responsible for vetting their contractors.<\/li><li><strong>Damages\u00a0<\/strong>&#8211; The damages in this case are less obvious. Attorneys for the plaintiff argued that Walker Engineering were responsible for Lopez&#8217; emotional distraught caused by losing her husband, and for causing additoinal harm by consistently blaming Murillo and extending the case, which took over 5 years.<\/li><li><strong>Evidence\u00a0<\/strong>&#8211; The most clear-cut evidence in Lopez&#8217; case can be boiled down to a few specifics: video footage of the accident taken from CCTV and employee records showing the boom lift operator&#8217;s lack of qualifications.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-b6389eb e-con-full e-flex e-con e-parent\" data-id=\"b6389eb\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-437456d elementor-widget elementor-widget-heading\" data-id=\"437456d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Why You Shouldn't Try to Handle an Injury Claim Alone<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7adc198f elementor-widget elementor-widget-text-editor\" data-id=\"7adc198f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>&#8220;But my buddy Greg says&#8230;&#8221;<\/p><p>No matter how much legal advice you receive from your friends, remember that the people you are going up against shut down cases for a living. Their livelihood depends almost entirely on shutting down your specific, individual personal injury claim.
