What Can I Collect in a Personal Injury Claim?

When you are hurt due to the negligence of another driver, you have a right to pursue a personal injury claim for all the losses you suffer as a result. Typically, this will include payment for:

Medical expenses: Our attorneys will thoroughly document the costs of surgeries, hospitalizations, doctor visits, imaging tests such as X-rays and MRIs, physical and other rehabilitative therapy, medications, and other medical expenses as part of your claim. We will also work with experts to determine future medical expenses you are expected to face as a result of your injury.

Wage loss: When you miss work due to motorcycle accident injuries, our attorneys will demand compensation for the loss of income, as well as payment for any vacation time or sick time you were forced to use. In addition, our lawyers will determine whether you will suffer diminished earning capacity in the future and demand compensation for those losses.

Pain and suffering: There are some types of losses that can seem impossible to put a dollar value on. However, our attorneys will demand fair payment to account for the physical and emotional pain and suffering you have dealt with due to your injuries.

If you have lost a family member to a tragic motorcycle accident, our attorneys can also explain your right to pursue a wrongful death claim against the at-fault party. A wrongful death claim can help families demand justice for their loved ones and seek financial compensation for an immeasurable loss.

How Do I Prepare to Make a Motorcycle Accident Insurance Claim?

When you think about filing an insurance claim, you may picture filling out a bunch of paperwork. However, the process for obtaining a full payout for a motorcycle accident claim requires much more work. Although a lawyer will manage the detailed paperwork, documentation, and deadlines, there are several steps you can take to prepare for filing a claim.

Report your accident to law enforcement. Calling the police from the scene of the accident will ensure that authorities are able to properly document the crash and file an accident report. This crash report can be helpful as your attorney prepares your claim for compensation.

Exchange information with the other driver. Be sure to get the driver’s name, insurance information, driver’s license number, and license plate number. If the driver was driving as part of work duties, ask for the name of the employer. If the driver was in a commercial motor vehicle such as a large truck, ask for the name of the trucking company and write down any numbers on the truck.

Get immediate treatment for your injuries. It is crucial for your health and for your claim to seek immediate medical treatment. Follow all your doctor’s orders, including seeing recommended specialists and attending follow-up appointments. Save all receipts and records related to your treatment, as these will be important documentation for your claim.

Collect any evidence at the scene. If you are physically able, you can do this yourself, or ask someone to do it for you. Take photos of your bike, the other vehicle, the positioning of the vehicles, and the scene as a whole. Take photos of your injuries as well as any other details that you think could be used as evidence, such as skid marks or traffic signs. Also, get the names and contact information for anyone who witnessed the crash.

Call an attorney as soon as possible. Once you have received treatment for your injuries and are ready to begin dealing with the insurance company, contact a lawyer. Do not give a written statement to an insurance adjuster or accept any payment before speaking with an attorney. Your lawyer will review all the evidence you have collected, investigate your crash, identify all potential sources of compensation, and manage all the details of your claim from here.

How Do I Make the Claim?

In order to make a claim, you will need to show who is at fault for the accident and identify which insurance companies have an obligation to you. This may involve:

Filing a claim with the at-fault driver’s insurance company: Drivers in Texas must have liability coverage to pay for victims’ injuries in accidents. However, insurance companies do not automatically pay the full value on these claims. You must be able to prove fault and provide detailed documentation of your damages. Although insurance companies will settle most claims, they will only do this if they believe it will be less costly and risky than going to trial. This is why having an experienced lawyer on your side is crucial.

Filing a claim against your own insurance company: Depending on the circumstances and your policy, you may be able to file a claim under your Personal Injury Protection (PIP) coverage or your uninsured (UM) / underinsured (UIM) motorist coverage. PIP can be paid regardless of who is at fault for the crash, and UM/UIM can be tapped if the driver who hit you was uninsured or did not have enough coverage to pay for your losses. You should have an attorney review your own insurance coverage to identify all your options for seeking compensation.
